1. INTRODUCTION
Welcome to the Golfies Tournament (the “Tournament“). The Tournament is operated by Golfies Pty Ltd ABN 32 680 294 642 (referred to herein as “Golfies“, “we”, “us”, or “our”).
Please read these terms and conditions carefully before registering for the tournament. Participation in the Tournament is subject to these Terms and Conditions.
By registering for the Tournament, you agree to these Terms and Conditions.
2. GOLFIES AMATEUR AMBROSE TOURNAMENT TEAM MEMBERS
To participate in the Golfies Tournament, a team must register and pay the required entry fee.
Each team consists of two players. For the purpose of these Terms and Conditions and without prejudice to any other gender, we will discuss handicap in the context of men and women.
An official golf handicap is required for participation. Both players in a team must be at least 18 years old before the Tournament starts.
Players with handicaps over 26 (men) and 30 (women) are welcome to participate, but for integrity purposes, their handicap will be capped at 26 and 30, respectively, regardless of any higher handicap.
When registering for team participation. The team must pay the participation fee before the start of the competition.
A player or team will lose their member status under any of the following circumstances:
- At the conclusion of the Tournament Season (See Tournament Schedule)
- If the team withdraws voluntarily
- If Golf Australia cancels or suspends their membership due to non-compliance with golf rules
- If the Golfies Tournament Committee decides to terminate their participation due to inappropriate behaviour during the competition year
- If the team fails to pay the required entry fee
- If the team breaches any of the Tournament Rules published at https://golfies.com.au/rules/ as determined at the sole discretion of the Golfies Tournament Committee
3. ENTRY FEES
Entry fees are set annually by the Golfies Tournament Committee and must be paid in full at the time of registration. There is no commitment period and no automatic renewal for future tournaments.
All fees are quoted in Australian Dollars (AUD) and include GST where applicable.
4. YOUR ACCOUNT & REGISTRATION
During registration, you will be required to provide certain information, including but not limited to your name, contact information, handicap details, username, and password (“Credentials”).
We handle all personal information (including your Credentials) in accordance with our Privacy Policy and applicable Australian privacy laws. You are responsible for maintaining the confidentiality of your Credentials and for all activity that occurs under your account.
If your contact information or other account information changes, you must promptly notify us and update your details. You are solely responsible for any activity using your Credentials, whether or not you authorized that activity.
You agree to notify us immediately of any unauthorized use of your Credentials or if your email or password has been compromised.
By registering, you consent to us using your name and/or team details in promotional materials, tournament listings, and results publications.
5. LICENSE AND REGISTRICTIONS ON USE
We developed an application (Golfies Application) that is accessible through our website. The Golfies application enables registered users, amongst other things, to view information about Tournaments as well information regarding their profile, upcoming matches, receive opponents contact details, view the tournament structure and keep scoring information for specific matches.
We grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the Golfies Application and utilise any services provided as part of the Golfies Application in relation to Tournaments or any other services offered from time to time.
You may not (and you may not permit anyone else to):
(i) Copy, modify, create derivative works of, reverse engineer, decompile, or otherwise attempt to extract the source code of the Golfies Application or any part thereof;
(ii) Attempt to disable or circumvent any security mechanisms of the Golfies Application;
(iii) Use the Golfies Application or Tournament platform for any commercial purpose without our express written consent; or
(iv) Scrape, harvest, or otherwise collect information from the Tournament website for any purpose not explicitly authorised.
If a user violates the licence conditions, we reserve the right to immediately cancel their registration and disable their use of the Golfies Application.
6. MEDIA RIGHTS, IMAGE & LIKENESS
By participating in the Tournament, you grant us the right to:
- Record, film, photograph, or otherwise capture your participation
- Use your name, image, voice, likeness, and biographical information
- Reproduce, distribute, publicly display, and create derivative works
These rights extend to all media now known or hereafter developed, throughout the world, in perpetuity, without compensation to you, for promotional, commercial, and archival purposes.
If you wish to limit the use of your personal image or information, you must notify us in writing at info@golfies.com.au before the commencement of the Tournament. We will make reasonable efforts to accommodate such requests, though certain basic information will remain necessary for operational purposes.
7. PRIVACY POLICY
Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, available at https://golfies.com.au/privacy-policy/. By participating in the Tournament, you consent to our Privacy Policy and the data practices described therein.
8. COMMUNICATION PLATFORMS
The Tournament may include forums, message boards, chat functions, or other interactive features (“Communication Platforms”). When using any Communication Platform and communicating with opponents through other means such as email, text message or phone, you must not:
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others
- Publish, post, distribute, or disseminate any defamatory, infringing, obscene, indecent, misleading, or unlawful material
- Upload or attach files that contain viruses, corrupted files, or any other similar software or programs
- Delete any author attributions, legal notices, or proprietary designations
- Falsify the origin or source of software or other material
- Advertise or offer to sell any goods or services for any commercial purpose
- Conduct or forward surveys, contests, pyramid schemes, or chain letters
- Download any file posted by another user that you know, or reasonably should know, cannot be legally distributed
We reserve the right to remove any content from Communication Platforms at any time and for any reason without notice. We may also terminate your access to Communication Platforms at our discretion.
9.COMMUNICATION CONSENT
By registering for the Tournament, you consent to receive communications from us regarding the Tournament, including:
- Tournament updates and schedules
- Results and standings
- Special offers from Tournament sponsors
- Future events and opportunities
We may communicate via email, SMS, phone, or through the Tournament application. You may opt out of marketing communications at any time by:
- Using the unsubscribe mechanism in emails
- Replying “STOP” to SMS messages
- Contacting us at info@golfies.com.au
Essential Tournament communications cannot be opted out of while you remain a registered participant.
10. AMENDMENT TO TERMS
10.1 Updates and Modifications
We may amend these Terms and Conditions from time to time. If we do amend the Terms and Conditions, we will publish the amended Terms and Conditions on our website and to the extent possible, provide notice by email to participants.
We urge you to review our website from to time to ascertain and download the latest version of these Terms and Conditions.
Your continued participation in the Tournament following the posting of changes to these Terms and Conditions will constitute your acceptance of those changes.
10.2 Right to Correct Errors
We reserve the right, in our discretion, to correct any errors or omissions in any part of the Tournament website, materials, or communications without notice or liability. Any material on the Tournament website may be out of date at any given time, and we are under no obligation to update such material.
10.3 Content Currency Policies
While we strive to provide current and accurate information, we do not guarantee the currency, accuracy, or completeness of information provided through the Tournament website or communications. Tournament schedules, venues, and other details are subject to change, and it is your responsibility to check for the most current information.
10.4 User Responsibility to Check for Updates
It is your sole responsibility to periodically check these Terms and Conditions for any changes. We may, but are not obligated to, notify participants of significant changes via email or other communication methods.
11. TOURNAMENT RULES & FORMAT
The Tournament will be conducted as a two-person Ambrose format (as defined in the Tournament Rules). Specific rules regarding handicap calculations, scoring, playoffs, and other competition matters are set forth in the Tournament Rules, which are incorporated by reference into these Terms and Conditions.
The Tournament Rules are available at https://golfies.com.au/rules/ and may be updated periodically. Each Tournament is played subject to the Tournament Rules as amended from time to time and we encourage participants to review the Tournament Rules before each Tournament.
The Tournament Committee has the exclusive right to:
- Modify the format of play due to weather or other circumstances
- Interpret and enforce all rules
- Make the final decisions on any disputes in the event the parties are unable to resolve the dispute
- Disqualify any team for rule violations or conduct detrimental to the Tournament
12. INSURANCE REQUIREMENTS
12.1 Participant Insurance
All participants are required to maintain their own insurance coverage, including:
- Personal health insurance with coverage sufficient for golf-related injuries
- Personal liability insurance for damage or injury caused to third parties as a result of their participation in a Tournament.
12.2 International Travel Insurance
For participants qualifying for the Thailand Grand Final:
- Comprehensive travel insurance is mandatory and must include coverage for:
- Medical expenses (minimum AUD $500,000 coverage)
- Emergency medical evacuation
- Trip cancellation or interruption
- Lost baggage and personal effects
- Proof of valid travel insurance must be provided at least 30 days before the Grand Final
- Failure to provide proof of adequate insurance may result in disqualification from the Grand Final Thailand Tour.
12.3 Tournament Insurance
The Tournament organisers maintain:
- Public liability insurance for Tournament events
- Event cancellation insurance
- Professional indemnity insurance
However, this coverage does not extend to:
- Personal injuries sustained during practice or play to players and or third parties
- Participants health.
- Damage to or loss of participants’ personal property including loss or damage to golf clubs and equipment, golf carts (unless provided by the Tournament organisers), personal effects left in clubhouses or on the course.
- Property damage caused to a participant’s property or third party as a result of the Tournament.
- Damage caused by an act or omission whether negligence, misconduct or otherwise by participants.
Each participant in a Tournament releases the Tournament Committee, the organisers of the Tournament, their directors, employees and agent from any liability that may arise as a result of participation in a Tournament.
13. HEALTH & SAFEY
13.1 Health Disclosures
Participants must:
- Disclose any relevant health conditions that may affect their participation
- Inform the Tournament organizers of any medications that may be needed in an emergency
- Notify staff of any incidents or injuries that occur during Tournament play
Information provided can assist Tournament organisers in the event of emergency but does not impose any obligation, duty or liability on the Tournament organisers in the event of an emergency.
- Medical Emergencies
In case of medical emergencies costs associated with emergency medical treatment are the responsibility of the participant
- Weather Policy
The Tournament Committee has established policies for:
- Heat (play may be suspended when temperatures exceed 38°C/100°F)
- Lightning (mandatory evacuation of the course upon warning)
- Heavy rain (play suspension at the discretion of the Tournament Committee/ Golf Course)
- High winds (play suspension when conditions become dangerous)
13.4 Pandemic and Infectious Diseases
The Tournament will follow:
- Current public health guidelines in both Australia and Thailand
- Specific protocols that may include testing, vaccination requirements, or masking
- Participants agree to comply with all health protocols in place at the time of the event
13.5 Physical Fitness
Participants represent that they:
- Are physically fit to play multiple rounds of golf
- Can safely walk the course or operate a golf cart
- Will take appropriate precautions regarding hydration and sun protection
- Have in place the necessary insurance coverage as required under these Terms and Conditions
14. CANCELLATION & SUBSTITUTION POLICY
14.1 Refund Policy
You may request a full refund within 14 calendar days from the date of payment if the Tournament has not yet commenced by submitting a written request to info@golfies.com.au.
Once the Tournament has commenced, refunds will only be provided if:
- There were insufficient teams in your local area to conduct qualifying rounds
- The tournament is cancelled by the organizers
- A medical emergency prevents participation (medical documentation required)
Refunds will be processed using the same payment method used for the initial transaction. Please allow up to 14 business days (being Monday to Friday Melbourne time) for refunds to be processed.
14.2 Participant Withdrawal
Participants may withdraw in circumstances other than medical (15.3) under the following conditions:
You may request a full refund within 14 calendar days from the date of payment if the Tournament has not yet commenced by submitting a written request to info@golfies.com.au.
- Full refund if withdrawal is within 14 calendar days from the date of payment if the Tournament has not yet commenced
- 50% refund if withdrawal is 15-29 days before the scheduled starting date of the Tournament
- No refund if withdrawal is less than 15 days before the scheduled starting date of the Tournament
14.3 Medical Withdrawals
For withdrawals due to medical reasons:
- A doctor’s certificate must be provided
- Full refund (less administration fee) if provided before tournament commencement
- No refunds will be provided if the tournament has commenced.
14.4 Team Reserve Substitution
For team member reserve players:
- Two reserve players can be nominated to support your team throughout the tournament.
- The reserve players must meet all eligibility requirements
15 DISCLAIMER OF WARRANTY
The Tournament Organiser warrants and represents that;
- it is authorised to offer the Tournaments and has the requisite licences and permits to offer the services and the Golfies Application;
- it will hold the necessary insurance coverage as stated in these terms and conditions for the duration of the tournament;
- the offering of the Tournament and the Golfies Application does not violate any intellectual property of a third party;
- it has the corporate power and authority to offer the Tournament and the Golfies Application;
Whilst the Tournament Organiser will use reasonable endeavours to select appropriate golf courses for the Tournament, the Tournament Organisers and Committee cannot guarantee the conditions of the golf course.
Except for warranties that cannot be excluded under the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010, the Tournament Organisers and committee exclude all warranties in relation to the conduct of the Tournament and the conditions of the golf course.
Each participant in the Tournament warrants and represents to the Tournament Organisers and Committee that;
- it has the necessary skills and physical ability to participate in the Tournament;
- it has the necessary clubs and equipment to participate in the Tournament;
- it has the necessary insurance as required under these Terms and Conditions.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or relating to your participation in the tournament.
This includes, but is not limited to:
- personal injury occurring during tournament play
- property damage
- lost profits or business opportunities
- loss of data or goodwill
- cost of substitute goods or services
- any other intangible losses
including if such damage or injury was caused by an act or omission of the tournament organisers.
Our total liability for any claims arising from or relating to the tournament shall not exceed the amount you have paid to participate in the tournament.
Nothing in these terms and conditions excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by law
17. DISPUTE RESOLUTION
Any dispute arising from or relating to these Terms and Conditions or the Tournament shall be resolved as follows:
- Informal Resolution: The parties shall attempt in good faith to resolve any dispute promptly through negotiation between the parties.
- Mediation: If informal resolution is unsuccessful, the parties agree to submit the dispute to mediation in accordance with the Australian Disputes Centre (ADC) Mediation Guidelines. If the parties cannot agree on a mediator, the mediator will be nominated by the president of the Law Institute of Victoria.
- Court proceeding : No party shall commence court proceeding unless mediation has been attempted and it failed. If mediation is unsuccessful, each party may commence proceeding in a court of competent jurisdiction seeking to adjudicate the dispute.
- Each of the parties agrees that Victorian law applies to these Terms and Conditions and participation in the Tournament and submit to the non-exclusive jurisdiction of the courts of Victoria.
Subject to any judicial review, if a dispute cannot be resolved, the Organiser Committee shall resolve the dispute and the parties must abide by the resolution.
18. INTERNATIONAL TRAVEL & GRAND FINAL
For teams qualifying for the Grand Final in Thailand:
18.1 Travel Arrangements
Participants are responsible for:
- Obtaining valid passports with at least 6 months validity beyond the travel dates
- Securing appropriate visas or travel authorizations for Thailand
- Arranging and paying for their own travel insurance
- Complying with all entry requirements for Thailand, including health requirements
18.2 Tournament Responsibilities
The Tournament organisers will provide:
- Flights & Accommodation
- Daily breakfast which is included in the hotel bookings;
- Daily dinners except as the program provides for optional dinner during a free day;
- Daily lunch except as the program provides for optional lunch during a free day
- Drinks for lunch and dinners subject to availability and wine, beer and spirit list provided by the Committee
- 4 rounds of golf
- Information about the venue and competition schedule
- Tournament-related transfers between designated accommodation and golf courses
- Tournament functions and activities as specified in Grand Final information
- Welcome reception and awards ceremony
- Assistance with local arrangements and recommendations
18.3 Accommodation
For the Grand Final:
- The Tournament has secured a block of rooms at preferential rates
- Participants may book within this block or make their own arrangements. Accommodation arrangements out of scope of what the Tournament organisers arranges are at the cost of the participant.
- The Tournament will provide transportation only from designated accommodation
- Any changes to accommodation must be communicated at least 14 days before arrival
18.4 Conduct
Participants must:
- Comply with all local laws while in Thailand
- Respect local customs and traditions
- Conduct themselves in a manner that reflects positively on the Tournament
- Attend all mandatory Tournament functions
- Follow dress codes for both golf and social functions
18.5 Cultural Considerations
Participants should be aware of and respect:
- Thai cultural norms and customs
- Royal family protocols and sensitivities
- Religious sites and practices
- Local etiquette regarding dress and behaviour
18.6 Safety and Security
For safety while in Thailand:
- Participants should register with their respective country’s embassy or consulate
- Keep copies of important documents separate from originals
- Follow any travel advisories issued by their home country
- Adhere to safety instructions provided by Tournament staff
19. TAX IMPLICATIONS
19.1 Prize Money
Any prize money or non-cash prizes awarded may be subject to:
- Australian taxation laws for Australian residents
- Thai taxation laws for prizes awarded in Thailand
- Withholding requirements in either country
19.2 Tax Reporting
The Tournament organisers will:
- Issue appropriate tax documentation for prizes exceeding AUD $1,000 in value
- Comply with all legal reporting requirements
- Withhold taxes as required by applicable laws
19.3 Participant Responsibility
Participants are solely responsible for:
- Declaring all prizes on their personal tax returns
- Understanding their tax obligations in their country of residence
- Seeking professional tax advice regarding international prizes
- Paying any taxes due on prizes received
19.4 GST Considerations
- All fees quoted include GST where applicable under Australian law
- International participants may be eligible for GST refunds under certain circumstances
- The Tournament organisers will provide tax invoices upon request
20. LOCAL LAWS COMPLIANCE
20.1 Australian Law
All qualifying tournaments in Australia will be conducted in accordance with:
- Australian consumer laws
- State/Territory sporting regulations
- Local council requirements and permits
- Liquor licensing laws for any functions involving alcohol
20.2 Thai Law
During the Grand Final in Thailand, participants must comply with:
- All Thai laws and regulations
- Sports Authority of Thailand requirements
- Local golf association rules
- Immigration and customs regulations
20.3 Legal Issues
In the event a participant faces legal issues during the Tournament:
- The Tournament organisers will not provide legal representation
- Consular notification will be made if appropriate
- The participant will bear all legal costs and consequences
- Participation may be suspended pending resolution
21. FORCE MAJEURE
Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- Epidemics or pandemics
- Terrorist attacks, war, civil unrest, or other major disruptions
- Government restrictions or actions
- Labor disputes or strikes
If a force majeure event occurs, we will make reasonable efforts to notify affected participants and may:
- Postpone Tournament events to later dates
- Relocate Tournament events to alternative venues
- Modify the Tournament format
- Cancel portions of the Tournament with appropriate refunds
The Grand Final may be relocated or rescheduled in the event of circumstances beyond our control affecting Thailand. In this context force majeure means any event that is beyond the Tournament’s organisers direct or indirect control including but not limited to act of God weather condition, political unrest, change in laws and regulations, unpredictable increase in cost of running the Thailand Grand Final etc.
22. INTELLECTUAL PROPERTY
All intellectual property related to the Tournament, including but not limited to trademarks, logos, trade names, copyrighted materials, and patents, are owned by us or our licensors. Nothing in these Terms and Conditions transfers any such rights to you.
The Tournament name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or those of our affiliates or licensors. You may not use such marks without our prior written permission.
23. SPONSORSHIP AND COMMERCIAL RIGHTS
23.1 Tournament Sponsors & Partners
The Tournament has official sponsors and partners whose support is essential to its operation. Participants acknowledge:
- Sponsor logos may appear on Tournament materials, websites, and venues
- Participants may be required to wear or display sponsor logos during play
- Sponsor products or services may be exclusively provided during Tournament events
23.2 Conflicting Sponsorships
Participants must:
- Not display or promote brands that compete with official Tournament sponsors
- Seek approval before displaying personal sponsor logos during Tournament play
- Not engage in “ambush marketing” activities that undermine official sponsorships (what does this mean?)
23.3 Commercial Rights
The Tournament organisers retain exclusive rights to:
- Broadcast, stream, or otherwise distribute images and recordings of the Tournament
- License Tournament-related merchandise
- Approve any commercial use of Tournament intellectual property
- Determine commercial activities permitted at Tournament venues
23.4 Participant Commercial Activities
Participants may not:
- Sell merchandise at Tournament venues without written permission
- Conduct promotional activities during Tournament events
- Use the Tournament as a platform for personal business activities
- Imply any endorsement of products or services by the Tournament
24. ACCESSIBILITY AND INCLUSION
24.1 Non-Discrimination
The Tournament is committed to:
- Non-discrimination on the basis of race, colour, religion, sex, national origin, disability, age, or any other protected characteristic
- Creating an inclusive environment for all participants
- Addressing accessibility needs to the extent reasonably possible
24.2 Accessibility Accommodations
Participants with disabilities:
- May request reasonable accommodations by contacting info@golfies.com.au
- Should make accommodation requests at least 30 days before the event
- May use motorized golf carts when medically necessary, even if carts are not otherwise permitted
- Will be accommodated in compliance with applicable disability laws
24.3 Inclusive Participation
The Tournament encourages participation from:
- Players of all genders
- Senior golfers
- Golfers with disabilities
- Players from diverse backgrounds
24.4 Service Animals
Properly trained service animals:
- Are permitted in accordance with applicable laws
- Must be under handler control at all times
- Must not disrupt play or course conditions
25. ENVIROMENTAL POLICY
25.1 Sustainability Commitment
The Tournament is committed to:
- Minimizing environmental impact
- Respecting golf courses and natural environments
- Implementing sustainable practices where possible
- Leaving venues in the same or better condition
25.2 Participant Responsibilities
All participants must:
- Repair divots, ball marks, and bunkers during play
- Use designated waste and recycling receptacles
- Follow all course-specific environmental guidelines
- Respect wildlife and natural areas
25.3 Carbon Awareness
For international travel to Thailand:
- Participants are encouraged to consider carbon offset programs
- The Tournament will provide information about reputable offset providers
- Group transportation will be arranged where possible to reduce emissions
25.4 Eco-Friendly Initiatives
The Tournament implements:
- Digital scorecards and communications to reduce paper use
- Water conservation measures
- Waste reduction and recycling programs
- Sustainable sourcing for Tournament merchandise and catering
26. CURRENCY AND PAYMENT PROCESSING
26.1 Currency
All Tournament fees and prices are quoted in:
- Australian Dollars (AUD) for Australian qualifying events
- Thai Baht (THB) may be used for purchases at the Grand Final
26.2 Payment Methods
The Tournament accepts payment via:
- Major credit cards
- Direct bank transfer
- Online payment platforms as specified on the registration site
- Other methods as may be indicated during registration
26.3 Payment Security
All payment processing:
- Complies with PCI DSS requirements
- Uses industry-standard encryption
- Is handled by reputable payment processors
- Includes fraud monitoring and protection
26.4 Processing Fees
- Credit card processing fees are included in the registration fee
- Bank transfer fees are the responsibility of the participant
- Additional fees for payment changes or special processing will be clearly communicated
27. ALCOHOL AND CONTROLLED SUBSTANCES
27.1 Alcohol Policy
Regarding alcohol at Tournament events:
- Responsible consumption is permitted at designated functions
- Participants must comply with local licensing laws
- Intoxication resulting in disruptive behaviour will not be tolerated
27.2 Controlled Substances
The Tournament prohibits:
- Use of illegal drugs or narcotics
- Misuse of prescription medications
- Performance-enhancing substances prohibited in sport
- Any substance that impairs a participant’s ability to play safely
27.3 Anti-Doping
The Tournament:
- Supports clean sport principles
- May conduct random testing in compliance with golf’s anti-doping policies
- Will disqualify participants found to be using prohibited substances
- Reports violations to relevant golf authorities
27.4 Tobacco Products
- Smoking and tobacco use are subject to venue-specific rules

- Electronic cigarettes and vaping are subject to the same restrictions
27.5 Consequences
Violation of these substance policies may result in:
- Warning and monitoring
- Disqualification from the current event
- Ban from future Tournament participation
- Reporting to relevant authorities as legally required
28. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Such invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
